Also, where in northeast Mississippi? My wife is from New Albany.
 
I agree with the ideas for the signs and the wind chimes. You should let him know that you do still live there. The entire situation is a little bizarre to me. My first impression is that he is either trying to get your townhome by forcing you out or he is running something out of his house that he does not want anyone to know about.
 
How about lots of bird houses? Then he can start paying you to keep the bird crap off of his cars...just keep pointing out the swirls and etching on his paint as you detail your car.



I love the idea with the pesticides...that would be GREAT!



Or you could call the police every once and while and tell them you want to remain anonymous and report "suspicious activities over at your neighbors house"
 
I wasn't going to post but this story is too good not to share:



The neighbour next to us was one of the retired grey haired types that prided himself on his yard, the perimeter of his backyard was surrounded by apple and cherry tree's that he'd collect and share generously with the neighbourhood. This wacko moved in on the other side of him and after several odd confrontations not so unlike yours he came home one evening to find that the neighbour has sawn off every single branch that hung over the fence. It's a deep property so we're talking maybe half a dozen mature trees.



The old guy goes out and gives him a piece of his mind and eventually a cruiser pulls up (we still don't know who called them) and they both told their story to the cop... technically the wacko was right and anything overhanging the property line he had the right to cut off. The old guy goes stomping off in a huff (this is the point where I saw the rest) into his backyard to survey the damage. I went out front out of curiousity and the wacko was thanking the cop for backing him up, with that we hear a chainsaw fire up run for a few seconds and shut off. The cop and wacko walk into his backyard and I into Mr.Newtons... He'd cut off the top 3/5's of the neighbours wood ladder that was resting up against the fence.



I get a chuckle out of it every time I think about it.



The wacko resold the house at a loss not too long after and we got another great addition to the community; the old guy sold his house 5 years later and retired (for good) to a big place up north. I heard it burnt down in a storm and that he took the insurance money and moved to Florida.



Oh, just to top it off; one time he was showing me a samuri sword he picked up on a recent trip to Japan... in a fit of lunacy he jumped up onto his couch and swung it in an arc, severing the light cord of the fixture hanging over the coffee table.



Hmm, trip down memory lane.

If he looks out his bay window I considered putting a nice NO TRESPASS SIGN KEEP OFF GRASS sign staked in my yard. He would see it everytime he ate. I want to do it out of spite but I am afraid of where it might lead.

You dont strike me as a guy that fears much, what do you have to lose?
 
This guys sounds just like the a neighbor that moved in next to my parents when I was a kid. The guy that moved in yelled at me once when I was in grade school for walking across his yard to the bus stop because I was leaving footprints in the dew. He pulled a neighbor kid out of a tree that he said was his only to find out that it was about 6 feet out of his yard when he got it surveyed for a fence.



This guy kept his yard spotless. Mowed every few days (but not in a good way, always the same direction and his grass never really looked that great). No flowers. No trees. He'd even tour the yard when he got home to pick up twigs.



Anyway, the guy ended up dieing in his forties of a heart-attack. That doesn't really help you, but I swear this guy got what was coming to him for treating everyone else like crap.
 
Sounds like this is the guy who keeps the baseballs and freesbies.



Seriously though, if he wants to play games then do everything within the law to piss him off. I would. Myself, I'd put up a fence and purposly paint it pink with bright purple and neon green pokadots on his side.
 
It sounds like you have your hands full with this guy. All the games discussed here would be fun, but only make the situation worst. You can't reason with unreasonable people :furious: In your settlement package you should have a lot plan, verify the property line to ensure this guy is right. I would then mark the line, and get the guy's agreement. At that point, I would plant a very nice two foot flower bed the length of the property line so there is no further debate and let it go.
 
I think tomstin is right. I personally would not try to intentionally make noises and annoy your neighbor. Who knows what he might do next? I would just keep to my side of the property, maybe put up a fence so that you don't have to worry about accidentally going onto his property.



Again, I really do feel bad for you, but I'm worried that if you try doing these blatant acts to annoy him, the whole thing will just get worse than it already is. Good luck...
 
At least your neighbor doesnt intentionally point his sprinklers at your truck so it water spotted ever morning at 6:15am!! AND the guy has full survallaince so im sure hes probably watching me out there every morning wiping it down!

If fences aren't allowed, then I'd be thinking seriously of some "barrier" landscaping. Bushes, small trees with low branches, you get the idea. That is, if you're going to stay for awhile.



I guess maybe I don't know the whole story, but even from everything you've said it still seems unbelieveable that he got an attorney involved. What a lovely soul. :wall
 
It struck me that the guy's surveyor may have been a friend doing a personal favor.



You should really check to make sure it's legit.
 
Since the guy is scum, he'd probably be happy to make a few bucks off you........



Why don't you kindly ask him if he would be willing to sell the off centered property to you so you could both have "squared" yards. You might get that for the price of a fence (couple grand). He probably wouldn't go for it, but wouldn't hurt to ask. Might even propose to him through his attorney to make sure things don't go south.

For the past 2 weeks I have been cutting the grass per the survey stakes and in a different direction (diagonal per themightytimmah's suggestion) to completely avoid his property. Yesterday I received a letter from my neighbors attorney. In the letter it states that I have two (2) weeks to remove any plants that I had around trees that were in question or they will be destroyed.



The letter also states that if I trespass on his property that he will be involving local law enforcement.



I really don't know what this guy's problem is but I have just resolved myself to stay on my side of the property, not give this guy the time of day, or any type of personal satisfaction over this.



I even considering putting up a "No Trespassing" sign myself but I feel that it will only continue to inflame the situation. :grrr :grrr

You mentioned townhome once and condo once. Which is it as the rules are different for each? A townhome may have a property line but a condo shouldn't. If it is a townhome with true property lines, you may have acquired possession of part of his property through the doctrine of adverse possession. You would certainly need to speak with a local attorney as to all the requirements to prove this, but basically if you possess property for the requisite number of years and exercise all aspects of ownership, the doctrine of adverse possession says you may have acquired title to the portion you exercise control over.



With condos, no one owns the ground, only the unit itself. Everything outside the footprint of the unit is considered common area. He may have a limited exclusive easement to use a certain portion. Possible to lose an easement just like ownership. You could have acquired his limited exclusive easement to the portion you mowed and landscaped.



Throw out a little of this to the guy and indicate you will be talking to an attorney.

Well instead of letting my neighbor destroy them I decided to remove them and give them to a family member for their home.

I also had sometime and went out and measured the front stake pictured below. It is off about 1.5 feet in my direction according to my deed and home owners association maps that were provided to me. I have thought about having the thing resurvyed but I have gotten estimates at $600 and $700. I am not sure if its worth it.



The difference puts the line in the center of the tree shown. Alot of the neighbors have asked me about the stakes and ripping up the bushes. I just point my finger at my next door neighbors house and shrug my shoulders.

Bummer, doesn't look like I am going to be able to help you much. I can get all the info I want from Lancaster County for free, but Chester County wants $10,000 for full digital access it looks like. Some thing like this is what I was trying to get for you...

It has the property line overlaid on to an aerial photo. The one you can buy is from 2000 so I don't know if that helps you much. They do have aerials from 2005 but that's where the $10,000 comes in I think. I'm not sure if the tree and landscaping where there back in 2000. If so it might pay to spend the $15 to get an idea of what is what.
