getting oil or water based paint overspray off of paint

What would be a safe approach to do this? Would using an aggressive polish take it off? I really don't want to use something like lighter fluid. Here's some info about the situation:

A person called one of those digger hotline numbers and one of those locater people came out to locate stuff. In the process he used that pink/orange paint on the grass and on the road to mark where stuff was. It was a windy day, and some of the paint got sprayed on the car. While not directly sprayed on the vehicle, you can tell there are some areas that are on the paint.
 
Personally, I would call that company and tell them what this guy did to your car! Take pictures of the damage, and tell them your talking to your lawyer!
Then have them pay for a body shop to repair the damage, and get that guy fired...

I use that paint almost every day. The stuff we use comes right off of paint and comes right off of clothes just by washing them. You might need a little clay on the car but it should come off easy.
 
Safest route is clay, followed with polish/wax/seal. Maybe not the fastest, but very effective and safe.

Here's a few pics of an almost brand new BLACK Civic with gray latex housepaint overspray. Sat for almost 2 weeks before the customer called. Was a biotch, but worth the money when it came time to collect.

Good advice on persuing an insurance claim. Many insurance companies pay very well for this. What's the other alternative? Body $$$hop!! Also, I've known situations where the body ship will tell customer that it's go to be resprayed, they keep the car for several days, then clay, P/W/S, final detail, call the customer, tell them their vehicle is ready, bill them for a respray they never did, and laugh all the way to the bank.

Try and inconspicuous spot and go at it. If the overspray lifts, you're good to go, proceed with the rest. Make sure to use FRESH clay and keep kneeding it. I used half a bar on this little bit. Enjoy.
