Yesterday I got a speeding ticket, caught going 76 in a 35, on radar.



Its written as "Civil Infraction, Careless Driving; 41 over (76 RADAR/35 SPLIMIT); High Speed Lane Change w/o Turn Indicator"



I dont know what he can do to me with it - its the first and only time I've ever been pulled over for anything, let alone ticketed.



Advice what I should do?? He told me he would "make it worse for me" if he saw me in court with it.



Also he told me, "I seem like a nice guy, probably rational most of the time and he doubts I drive like that often, but my driving decision in the situation was stupid and my driving sucked."



What do I take from this?? I'm kinda scared my liscence will get suspended/revoked which would be a major problem for me. :scared

You're lucky he didn't nail you for a criminal infraction. On the other hand, I would ignore his idle threat about seeing you in court. He can't make it any worse than what he originally wrote you up for.



If you can't go to a traffic school to get it dismissed/reduced, you'll have to take your lumps. Seventy-six in a 35 in pretty stupid. You should have taken the cop to dinner for not adorning you with silver bracelets.
 
Any friends or family that are lawyers???? Ask them for advice. Most likely a fine and insurance rates going up.

yeah I'm looking into the traffic school thing - my insurance agent once told me a long time ago (right after I got my EXPENSIVE INSURANCE firehawk) that if I ever took that it would give me a "rate discount" on the insurance.



My main concern is them being able or not being able to take my liscense away.
 
i think it is very possible that you might get your license suspended. it really doenst matter that it was your first anything. 76 in a 35 is extremely careless. getting your license taken from you might be the best thing for you because i doubt it was the first time that you were speeding like that. dont know how it will work in MI but i swear i have heard that double the speed limit in CA is a felony. if i'm wrong, somebody correct me.
 
If it's your first time there is only a 50% chance you won't be able to drive for a little while.



Expect at least a huge fine and possibly some community service. It could be worse.



I know there's nothing you can do to change it now and you don't want people to say you should of done something else but to my knowledge isn't 35 mph a residental speed limit .... and isn't 70+ mph a highway speed limit ........... see where I'm going with this?



P.S. Trust me, I'm not some old fart that never stepped on the gas so don't think I'm being a pain. I got my Camaro SS at 19 and I'm 20 now and I use the power, trust me, just at the right time and the right place.
 
Take the advice from me...I have been pulled over plenty of times and still have no points on my license!



Take the ticket to court. If where you live is anything like Miami-Dade County, before the ticket goes to trial (where the cop would show up), you have a Pre-Trial Conference. At this PTC, the judge will give you the option to plead No Contest to what happened. What you want is no points and no school. Depending on your age and past driving record, the judge may with hold adjudication. This means it stays on your record but you have no poitns and your insurance cant go up...Look into it
 
Hire an attorney, that is the best thing to do right now.



As other have said you are very lucky. Your car could have been searched, towed and impounded while you went for a free trip downtown to the county's bed and breakfast.



What type of area were you in when you were pulled over? Residential, commerical, amount of traffic, road conditions, etc? These will be deciding factors in the outcome of the case.



Yes, I speed, but that is to keep up with traffic. The 85 percental rule.

I wish it goes well for you. I know what you are going through. I went through a speed camera about 5 and a half weeks ago. At the time i was test driving a fresh registered Silver Seraph which was to be advertised for sale at the showroom. I wasnt even going that fast, i was going 52mph in a 40mph zone. No arguing though with a camera. I ended up with another slap on the wrist with a £60 fine, and asked to produce all driving documents.Next time i will take the plates off the cars.

What's the 85% rule? I've heard 10% rule - don't go more then 10% over the posted limit
 
I don't know where you are, but if memory serves in Oklahoma anything over 20 over posted is a Felony. My DL would be the least of my worries. I would be more concerned with having a felony conviction on my record.



Check your local and state statutes and hire an attorney for professional advice. You need to take this one serious.
 
Your infraction will NOT qualify for traffic school. You're in serious trouble. Minimum 2 points on your license and lots of $$, and if your insurance company finds out.....



Your only hope is court, WITH A LAWYER. worst case, you get what is coming to you. best case, you get off completely because the cop screwed up something on the citation or doesn't make the court date. Probably you will get something less than the maximum, which may well be worth pursuing. You really should get a lawyer on this one.
 
Well guys, I did get extremely lucky. The officer hooked me up with a lesser ticket offence. The way he wrote it by law in this city/state, my ticket comes to $170 fine, 3 points on my liscense. Thats it.



In MI we have up to 12 points in 2 years without any license suspension/revocation. Therefore I'm in good shape if I watch my back from now on. Law doesn't even require me to inform my insurance company of it (and do you think I'm going to? no chance.)



so, for now, my worries are over. :up :)
 
You should be thankful that you didn't hurt or kill somebody!



If you had, the ticket would be the least of your worries. You should keep that in mind when doing 76 in a 35.



I have had my share of speeding tickets too, and am learning to slow down! It's not worth the gamble.
 
Not to worry, when your insurance company pulls a yearly report on you, they will let their fingers do the walking. :(

not to mention what it might do to some of my more "upscale" detailing customers.... (I make it a policy to make a copy of my driving record available to customers since I do move their vehicles on the street when turning them arround to be a different direction in the garage, etc.)

When I was in Irvine a few days ago, I got ticketed approx. $280 for a RIGHT-turn on red (with a no right-turn-on-red sign) and a 41 in a 35 mph zone. :( Irvine cops are mean! :D



I did, however, go to traffic school so nothing bad went on my record.

Back in the day, (high school) I had a LAW teacher get pulled over for going 27mph in a 25mph zone AND get a ticket. Now how dumb is that? He got it thrown out in court though.



I have talked to a cop friend of mine. He says they should give you a 10mph buffer, where lets say the speed limit is 35....they shouldn't go after you until you hit around 45mph or so. This is due to your speedometer being calibrated (could be off if the car is older) and their machines could be off as well.

There are some IL cops that are brutal as well. I go through one of the most notorious speed traps on my way to work (Stone Park, IL). On average, I see 2-3 cars pulled over en route to work. Today, I saw a Stone Park cop nail someone on the premises of my job.
