Anyone have trouble collecting on a bad check?

Scott go to the bank that the check is drawn on. Tell the manager that you want to protest the check. The bank will notify the customer that the check is in protest and they have 7 days to make it good. If by chance they choose not to, it a federal crime in N.Y. State not sure about Texas. This should at least scare them.



No offence, if it were a federal law that would mean anywhere in the country.
 
Bring 2 gallons of gas to her house Make sure she is home and ring the bell,when she opens the door start spilling out the gas on her front steps.now that she is scared SH__LESS ask for her for your money if not you going to BURN HER OUT.I HATE people that write checks with no money behind them.Then you call and they say the check is in the mail.This person has no intention of paying you so you have to do something DRASTIC.ASKING you to detail the other car is just a DEVERSION

I called her today and she answered the phone so it isn't like she is avoiding my calls. She still says she mailed it a week ago Friday. She said I could come by but I am not going to be anywhere near her area until Saturday. She said she would mail me a MO for the amount plus the $6 my bank charged me and if I don't have it by Saturday to come by and get the cash.



I told her it had to be resolved this week or I would turn the check over to my attorney.



I really don't like paying hardball because she may have honestly thought the money was in their account and she really did mail me a replacement check (I told her at this point it had to be a money order or if I have to come out Saturday, cash) that got lost. I don't want to lose a potentially good customer over what may be an honest series of mistakes but I also don't want to be too lax and get screwed either.



It is a real fine line I have to walk here....

I know exactly how you feel Scott. Us being business owners basically take on a 6th sense of customer service, and more times than others, we will honor the customer no matter the situation, and no matter who is in fault...but sometimes we have to "bite the bullet" and let them know we will not tolerate being taking advantage of, or ripped off.



I wish you luck in resolving this problem...I'm sure it will end up well. From what you are saying, it does sound like the customer may have a legitimate excuse, but she does need to act on it alot more better. It could be because alot of us are a small one man business and people may not feel threatened by that...therefore they in turn do not take certain aspects of our operations seriously.
 
I have a collection attorney and have to use his servicves every once in a while. I've never had anyone personally write me a bad check for a detailing job or anything else but in my experience businesses do this more than people do. Some of it is because of complicated issues having to do with seperate bank accounts for different budget departments (a lot of car dealers for instance have a marketing department with its own account and write checks for marketing expenditures out of that account) but sometimes its just because people are idiots. My mother also owns a business and she has a customer that can never seem to pay her properly, always 3-4 months behind, sends checks for as little as $10 that wind up bouncing. Huge PITA.



It sounds to me like she's not trying to screw you but she may live dollar to dollar and may be trying to string you along until she can get you the funds. She may do this all the time thats why she seems so aloof about it. You'd really be surprised how even people who make an astounding amount of income never have any money and live a month or more behind.

Believe me, I have a lot of female customers who are absolutely smokin' hot but they are all married to real rich guys. :(
