Don't do business with internet pirates

A member of the community emailed me to let me know a pirate was illegally using my photos (thank you, Ben!).

I contacted the web master and he replied as follows:

I'll be happy to remove your image as soon as you can provide proof of copyright. All of our images on the site have either been provided by manufacturers, or purchased from stock galleries and compilations, so i'm sure you can understand why we would need proof.

They are basically refusing to remove the photo.

Help me put the thieves in their place... don't give them your business and spread the word.

Did you ask where he got the image from? He said he purchases from stock galleries and compilations. Why don't you find out where he got them?

He very well could have purchased it legally not knowing it was pilfered from you.

Or he coould be a snake and just took it off your publications.

I'm sorry to hear this has happended but I would love to know the truth behind how he came about your image.

Do you have any legal measures you can take?

DMCA take-down notice to them and their ISP. Preferably on letterhead from someone named "Esquire."

They're also in violation of their ISP's AUP by hosting copyrighted material - http://www.ev1.net/english/about/aup.asp Same folks you use, right David? Should make life easier.

This is ridiculous. How would you prove copyright with a digital photo?

I think you can watermark the photos to help protect them in the future.
