Business Liscense question

I've asked around and I've gotten mixed answers. So maybe someone on here will have some sort of definitive answer. right now I'm structured as an LLC in Michigan. When I move to South Carolina in a week or so do I have to "re-do" my LLC and DBA in South Carolina or no? Some say yes because I'm in a new state and my name is only good in Michigan. Other's say no because being an LLC (in essence a corporation) I'm good. (people create corps in Nevada all the time for the tax breaks and operate in other states) So I'm a little confused and South Carolina's government site really dosen't answer the question. Any business Laywer's in the crowd or someone that know's one way or the other?

Yes you will need to re-file. An LLC title allows you to do business anywhere, but not be located anywhere. You need to re-file for state tax reasons.

Will I also have to get a new federal EIN then as well? I guess I could just wait until I get there. The bad part seems to be that the SC.gov site is telling me I need to go to Columbia to do anything down there for filing. (Michigan you can basically go to any local court and take care of it instead of heading to the capitol) Which is fine I guess. But columbia is a few hours away so If I don't have all my ducks in a row before I head out it's going to make for a lot of long trips... So the more I know the better I feel.

First of all, I would make a call to the Court in SC to see what you really have to do. Asking us who might have never done this, you might get the right answer but most of the time it is wrong. You Federal Tax EIN should be good. Major companies do business in alot of states but their companies are registered elswhere like Deleware. You need to check this out also for verification.

I'm almost 100% positive your EIN is good. I'm pretty sure you can own 2,3,w.e amount of sole proprietorships and you use the same EIN for each one. I think you'll have to refile just because your address is going to change, I really don't know for sure though, just my guess.

I guess I'll just call when I get there and see what the local gov says about it all. Hopefully it's not a painful process.
